Mwaura Defends Legal Basis for Shifting Public Seal to Head of Public Service

Government Spokesperson Dr. Isaac Mwaura has defended the recent transfer of the Public Seal from the Office of the Attorney General to the Head of Public Service (HOPS), dismissing concerns over its legality.

Speaking during a press briefing on Monday, Mwaura said the move was anchored in law and followed due parliamentary process through the National Government Administration Laws (Amendment) Act, 2023.

“The law was passed by Parliament and duly assented to by the President. There is nothing unconstitutional about the Head of Public Service being the custodian of the seal, as they are responsible for executing presidential directives,” said Mwaura.

He was responding to criticism that the change undermines the authority of the Attorney General, who traditionally held custody of the seal used to formalize key state instruments.

Mwaura maintained that the new arrangement enhances efficiency within the Executive and aligns with the President’s administrative structure.

The Public Seal is a critical symbol of state authority and is affixed to official documents such as appointments and constitutional instruments. Its reassignment has sparked debate among legal professionals and civil society groups who fear the move could weaken institutional checks and balances.

“The constitutional role of the Attorney General remains intact. This adjustment does not interfere with legal advisory functions,” Mwaura added.

He urged leaders to avoid politicizing administrative reforms, saying the government remains committed to transparency and rule of law.
