COURT DECLINES TO DECLARE MURKOMEN UNFIT, SETS OCTOBER MENTION

The High Court in Nairobi has declined to issue orders declaring Interior Cabinet Secretary Kipchumba Murkomen unfit to hold office. The case, filed by the Gema Watho Association, accuses Murkomen of inciting the use of excessive force during the June 25 protests, in violation of the Constitution.
The petitioners argue that Murkomen's alleged “shoot-on-sight” remarks encouraged extrajudicial killings and breached Article 26, which guarantees the right to life.
In her ruling, Justice Bahati Mwamuye stated that the matter requires further consideration and declined to issue any interim orders. The court has set October 27, 2025, as the date for mention of the case.
Other named respondents in the suit include the Ethics and Anti-Corruption Commission (EACC), Independent Policing Oversight Authority (IPOA), National Police Service (NPS), Inspector General Douglas Kanja, the Law Society of Kenya (LSK), and the Mount Kenya Jurists Party.
