KRA ENFORCES MANDATORY CERTIFICATE OF ORIGIN FOR ALL IMPORTS

The Kenya Revenue Authority (KRA) has introduced a new mandatory requirement for all goods entering the country, a move that will significantly impact importers, customs clearing agents, and the general public involved in import activities.

The directive, which takes effect from July 1, 2025, is part of amendments introduced under Section 44A of the Tax Procedures Act, CAP 469B, through the Finance Act, 2025. The aim is to enhance transparency, accountability, and efficiency in customs operations.
“This measure is critical in strengthening compliance and ensuring accurate declaration of imported goods,” the statement read in part.
A valid Certificate of Origin must:
Be issued by a recognized authority in the exporting country,
Clearly indicate the exporter’s and importer’s details,
Specify the port of origin, description, and quantity of goods,
Confirm the country of origin and destination.
KRA has warned that failure to present a valid COO may lead to seizure or forfeiture of goods. However, to ease the transition, a grace period has been granted until September 30, 2025, after which non-compliant imports will be forfeited to the state.
The tax authority has urged all stakeholders to ensure their foreign suppliers are informed of the new rules and to start submitting the required documentation immediately to avoid delays at ports of entry.
The new requirement marks a significant shift from previous regulations where Certificates of Origin were only needed under preferential tariff arrangements.
