MALALA:DCI CANNOT ARREST GACHAGUA ON ARRIVAL

Democracy for the Citizens Party (DCP) Deputy Leader Cleophas Malala has dismissed reports that the Directorate of Criminal Investigations (DCI) plans to arrest former Deputy President Rigathi Gachagua when he jets back into the country on Thursday, August 21.
Speaking on Monday August 18, 2025, Malala described the threats as empty and lacking legal basis. He argued that Gachagua’s controversial remarks linking President William Ruto to terror group Al-Shabaab and Sudan’s Rapid Support Forces (RSF) were already matters of public record, even being debated in the U.S. Senate.
“Those are ordinary threats. Gachagua cannot be arrested at the airport. Why should he be detained for statements that are already public knowledge?” Malala posed.
He insisted that if investigators needed a statement from Gachagua, it could only be taken before proper institutions such as the U.S. Senate or the International Criminal Court (ICC).
The former Kakamega senator further warned that any attempt to arrest Gachagua at Jomo Kenyatta International Airport could trigger chaos, given the thousands of supporters expected to receive him and the ongoing African Nations Championship (CHAN) matches that have strained Nairobi’s traffic flow.
Malala urged security agencies to avoid actions that could spark public disorder, saying political differences should be handled within the law.
