NONINI SUES CAR DEALER OVER GOLIATH WA BUNGOMA'S ADVERT

Kenyan musician Hubert Nakitare, popularly known as Nonini, has filed a legal complaint against Nairobi-based car dealer CarSoko for allegedly using his hit song “Kadhaa” without permission in a promotional video featuring social media influencer “Goliath wa Bungoma.”
In a letter sent through his attorney, James T. Makori, on June 10, 2025, Nonini accused the dealership of copyright infringement after it shared a short advertisement on its social media pages, including Facebook, TikTok, and Instagram. The advertisement was showcasing a collection of luxury vehicles in the dealership with Nonini’s music playing in the background.
The ad featured influencer Isaac Otesa, alias “Goliath wa Bungoma,” and was allegedly created without obtaining a synchronization license. The license grants specific rights that allow music to be paired with video content, as enquired under Kenya’s Copyright Act Cap 130.
Notably, this isn’t Nonini’s first legal battle over his music. In a landmark 2022 ruling, he won a copyright infringement case against influencer Brian Mutinda and Syinix Electronics for similar unauthorized use of his music in an online ad. The court ordered Mutinda to pay Nonini KSh 1 million, however after an appeal, Mutinda was ordered to pay Ksh. 4 Million.
