In a landmark moment for justice in Kenya, the government has paid out KSh 16 million (approximately $124,000) to four survivors of sexual violence from the 2007–08 post-election crisis. This marks the first official state compensation to victims of conflict-related sexual violence in the country's history.
The four beneficiaries were part of a group of eight survivors who filed Petition 122 of 2013, seeking accountability for the government's failure to prevent and respond to sexual and gender-based violence during the post-election turmoil.
In December 2020, the High Court found the government liable for violating the survivors’ constitutional rights by failing to conduct proper investigations and prosecutions. The court awarded KSh 4 million to each of the four survivors, recognizing the harm they suffered.
The judgment was hailed as a groundbreaking victory by human rights organizations. “This is not just a win for the four women—it’s a statement that the state can no longer ignore survivors of conflict-related sexual violence,” said a representative from the International Commission of Jurists (ICJ-Kenya), one of the supporting organizations in the petition.
While the recent payout signals progress, rights groups note that the remaining four petitioners are yet to receive justice, and many more survivors of similar violence across the country remain unacknowledged.
The compensation comes nearly 17 years after the violence, which left over 1,000 people dead and hundreds of women and men subjected to brutal attacks.
This payout sets a legal and moral precedent for how the government addresses sexual violence during periods of conflict and civil unrest going forward.
