An application seeking conservatory orders to bar Deputy Inspector General of Police Eliud Lagat from accessing his office, performing his official duties, or utilizing any National Police Service (NPS) facilities has been formally withdrawn. The application has been filled in connections with ongoing investigations into the death of blogger and teacher Albert Ojwang’ while in police custody. The court was informed that the matter has been overtaken by events, leading to the withdrawal. Lawyer Ndegwa Njiru, representing the petitioner, told the court that they would be seeking leave to amend the main petition to reflect the new developments. Justice Diana Kavedza granted the request, stating that the application is withdrawn and it will be mentioned on July 10, 2025, for directions on the main petition.
Deputy IG Lagat voluntarily stepped aside on June 16, 2025, to allow independent investigations into Ojwang’s death, which has drawn widespread public outcry and condemnation from opposition leaders and human rights organizations. In a public statement, Lagat said his decision to step aside was made in good and conscious thought of his duties, to facilitate impartial investigations by the Independent Policing Oversight Authority (IPOA). At least six individuals have been charged with Ojwang’s murder including Central Police Station OCS Samson Talam and Police Constable James Mukwana.
